These Terms & Conditions govern your relationship with Peter Handscombe (trading as Neat & Tidy Gardens) and all orders you may make. Please read them carefully as they may affect your rights and liabilities.
1.The Neat & Tidy Gardens Website is provided to you free of charge for your personal use, subject to these Terms and Conditions. By using Neat & Tidy Gardens website and services you agree to be bound by these Terms and Conditions.
2.The Neat & Tidy Gardens website is owned and operated by Peter Handscombe of Unit 11, St Georges Tower, Hatley St George, Sandy, Bedfordshire, SG19 3SH.
3.These Terms and Conditions do not affect your statutory rights.
4.Service Use
4.1 Your submission of an order amounts to an offer to enter a contract to use our service; you cannot then withdraw or cancel your order except as stated below.
4.2 Ordering our service carries with it the obligation to pay for it unless we receive from you a cancellation of your order 24 hours before the arranged appointment. We reserve the right to charge in full for any service unless we have received notice of cancellation before the 24 hour deadline. Any payments you have made for orders which have been properly cancelled will be re-credited to you. Any materials purchased at the time of cancelation will still need to be paid for.
4.3 Neat & Tidy Gardens will endeavour to warn you of any changes to our prices. However, we reserve the right to change our prices without notice.
4.4.Neat & Tidy Gardens reserves the right to refuse, amend, extend or cancel any special offer at any time.
5.Appointment Times
5.1 We endeavour to keep your pre-arranged appointment time to within the time slot agreed, but we reserve the right to change it and will tell you if we do so within a reasonable time.
5.2 If we are unable to attend at the arranged appointment time, for reasons beyond our control, for example adverse weather conditions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss this causes. We will not charge for services unless or until we have delivered them to you.
6.Payment Terms
6.1 Any issues regarding an invoice must be raised within 3 working days.
6.2 Where credit is granted, unless otherwise agreed in writing, all sums payable must be paid without deductions within 7 days of the invoice date.
6.3 Neat & Tidy Gardens reserves the right to use legal proceedings and/or debt recovery agencies to recover unpaid debts that exceed the payment terms. The customer shall be liable for any such legal fees and/or debt recovery fees. These fees will be added to the amount owed.
6.4 Failure to pay by the due date shall entitle the Company to suspend delivery of all unexecuted or future orders
6.5 Neat & Tidy Gardens reserves the right at any time in its absolute discretion to demand immediate payment of any account whether due or not.
7.Ivy Removal (and other self-clinging climbers)
7.1 Structural Damage
Ivy often grows into walls, fences, trees, and other structures. Neat & Tidy Gardens cannot be held responsible for any damage revealed or caused during removal, including cracks, loose mortar, damaged brickwork, render, paint, or bark. Ivy can conceal existing weaknesses that may become visible once removed.
7.2 Regrowth and Follow-Up Treatments
Full ivy eradication cannot be guaranteed after one visit. Ivy may regrow from remaining roots or inaccessible stems. Additional visits or chemical treatments may be required and will be quoted separately.
7.3 Access and Safety
All ivy removal work is carried out only where it is safe to do so. Work at height, near power lines, or on unstable surfaces may require additional equipment, safety measures, or incur extra costs.
7.4 Waste Removal
Ivy waste is often bulky and heavy. Green waste collection and disposal are included only if stated in your quotation. Otherwise, waste will be neatly stacked on-site for customer disposal.
7.5 Neighbouring Property Boundaries
Neat & Tidy Gardens accepts no liability for ivy growing through, over, or attached to neighbouring fences or properties. Removal will only be carried out within the customer’s property boundary unless prior permission has been arranged.
